Trepanier Manor Foreclosure

Trepanier Manor project in Peachland faces receivership!

October 2011
Trepanier Manor project in Peachland faces receivership!!

Trepanier Manor
Scott Wilshaw
Byron Dafoe
Richard Dudelzak
Eagle Mountain Investments

Officially announced in February, 2006, Trepanier Manor was described as an ultra luxurious, 38-room hotel with 20 upscale homes on just over 25 acres of property off MacKinnon Road.

Winter 2009, Matcon Construction put in servicing for the property, including water and sewer lines, electrical cables and other underground services. Prior to servicing, a show home was constructed on the property.

Fast forward to present day and it seems there has been no action at the site.

But the action in the courts is heating up. Trepanier Manor has more lawsuits (now 7) against it than it has homes built.

- March 2, 2010, Matcon Construction (File Number 86533) filed a lawsuit against the developer. The construction company claimed the developer still owes $510,459, according to court documents.

- July 23, 2010, Royal Bank of Canada (File Number 44537) claims that over $420,000 is left owing by the group and rumor has it that the bank has taken possession of the Trepanier Manor show home!

- January 18, 2011, Business Development Bank of Canada (File Number 45175) started a suit against Trepanier Manor, DaFoe, Dudlezak, Wilshaw and others, claiming that a $150,000 loan was unpaid.

- July 15, 2011, Canadian Western Bank (File Number 91989) began proceedings against Trepanier Manor, claiming that the company defaulted on its mortgage. The Canadian Western Bank is going after Wilshaw, Dafoe and Dudelzak in the amount of $4.6 million, alleging that the three principals of the project signed a limited liability guarantee to secure the mortgage. Canadian Western also asks the court to appoint a receiver for the project and put the whole project into receivership which would instigate the selling off of Trepanier Manor assets to pay the mortgage.

- Trepanier Manor is also involved in several other lawsuits. July 2009, Ponderosa Golf Course developer Treegroup (File Number 31887) sued Trepanier Manor for false and misleading information. February 2011, Super Save Disposal (File Number 90307) and June 2010, Capri Insurance (File Number 87757) have each started a suit against Trepanier Manor / Scott Wilshaw as well.

NOT a brilliant land developer

Comment
Scott Wilshaw is NOT a brilliant land developer
I was wondering when people would finally realize that a cook nobody ever heard of was NOT a brilliant land developer.
He jumped on the Okanagan building boom bandwagon (till 2007) like everyone else and got in over his head because he HAS NO EXPERIENCE in real estate.

Buried under enormous debt and reckless spending, the Trepanier Manor Development predictably collapsed under former director Scott Wilshaw.

the ‘luxury’ Trepanier Manor show home is garbage

BTW - the ‘luxury’ Trepanier Manor show home is garbage. It was built by 19-year olds working for 23-year old foremen.
The crew had less than 15 years experience - COMBINED.
The roof was leaky, the crown space a mess. I saw this with my own eyes when I worked there. It was tragic. Even a high school dropout was working for Scott Wilshaw. Stoned, drunk, whatever! Party on, dudes! I was called in to fix stuff
that was broken and done wrong on this BRAND NEW million dollar show home. All it takes is a shiny granite counter and some stainless steel appliances and suddenly everyone thinks it a great idea to speculate on this tacky ‘luxury’ development in Peachland.
Ha ha ha ha ha ha!
I guarantee this ‘luxury’ show home is falling apart in 5 years. Guarantee.

Too bad for this business clown … he should have finished high school … welcome to the real world !

Scott Wilshaw has scalped a beautiful mountain

Comment
Scott Wilshaw has scalped a beautiful mountain with the most thoughtless, inconsiderate and greedy development plan known and has created an eyesore from every vantage point within Peachland.

There is no doubt that Wilshaw was siphoning funds from Vineyard Catering and Hainle. The guy invested $0.00 yet, lives the lifestyle of a successful developer. Some investors are left with nothing, while Wilshaw continues his private trips is just plain wrong. Some of these guys invested their retirement savings, and are now left with nothing. These investors put there money into something that if run correctly, should have given them a return if not broken even. Instead, a crook used the investments of others to live the lifestyle he so wanted. He couldn’t make it in the hospitality business, because both, the salaries weren’t high enough for him, and more importantly, he wasn’t that good. Hope Scott Wilshaw ends up behind bars and has to pay anyone back.

What a dirtball

Comment
Boy, Scott Wilshaw sure turned out to be a slick shyster who had no problem screwing his former partners and investors. What a dirtball!

Many locals are angry about Trepanier Manor and developer Scott Wilshaw

Comment
Many locals are angry about Trepanier Manor and developer Scott Wilshaw. He destroyed the area, shaved the mountain of trees, leveled everything in sight and has no regard for nature and the natural beauty of the area. Sucking up resources like water is not the way to go.

he is nothing more than a jock

Comment
Scott Wilshaw is not a businessman, he is nothing more than a jock that had some connections. He built one show home and an ugly entrance and in 5 years he owes the banks 10,000,000 dollars…Not sure how he figured that out, but I bet the whole Trepanier Manor concept is faulty. I hope locals get some satisfaction of seeing this guy in the poorhouse anyway.

in hot water for outstanding loan payments

Comment
The planned Trepanier Manor initiated by Scott Wilshaw, whose finances were paper thin is now in hot water for outstanding loan payments. If they had gone forward with construction of the hotel, the building never would have been finished and their would have been a hulking, empty mass in the heart of Peachland.

Wilshaw has lost many good employees

------------------------------------------------------------------
Comment
“Scott Wilshaw is a very, very intimidating human being and he does have a temper,”a former employee told after he was fired. “He does talk to people disrespectfully. I’ve seen him do it dozens and dozens of times.” "The first time Wilshaw became abusive with him, “he was so angry, he got in my face, he actually spit in my face. He is not nice”. Wilshaw has lost many good employees"

The Trepanier Manor “concept” was doomed from the start

Comment
The Trepanier Manor “concept” was doomed from the start.
a) Just because you enjoy a good restaurant or a spa treatment is no reason to buy one of the 20 homes there
b) They should have done a smaller and smarter hotel development, not a wham! 4 story hotel and 20 homes
c) Folks in the Okanagan want a resort very near the water, preferably without having to depend on a vehicle
(Hey, Scott, don’t ‘blame the market.” just blame your own stupidity & ignorance.)

Comment
Scott Wilshaw and Trepanier Manor
Driven to succeed, used intimidation to hide his lack of skills, had his little corrupt team all covering up their stupidity, psychological need to see a doctor.
Gains the cooperation of some locals with lofty promises to build a hotel and 20 homes until his true self surfaces

Clearly they have been misled by the developer

Comment
The developer is in breach of contract for not having built the “luxury hotel and facilities” that were promised, for example “the five star hotel, swimming pools, spa, leisure facilities like tennis courts, bar and restaurants.” “Buyers expect to receive what they have paid for but they have been very badly let down indeed. Clearly they have been misled by the developer, and want to get justice.

Trepanier Manor has big financial problems

Comment
I know Trepanier Manor has big financial problems. Work was supposed to begin on the hotel in 2009, but it has not happened. There is still only one ‘cottage’ on the Manor property. I do not think there was a lot of support for the Trepanier Manor Project. Many people felt that the project is/was just ‘overblown’ and would run into difficulty. Now, many like me, are just hoping that they can salvage something so that Peachland is not left with a decapitated bench, denuded landscape and a damaged riparian zone. They still have off-site work to complete. The reservoir at the end of Cousins Rd was supposed to be expanded in Fall 2009 but it didn’t and still hasn’t happened.

This development appears to be dead in the water.

not that they would want to showcase the way it looks at present

Comment
I just visited the Trepanier Manor website to get an update. There isn’t one. In fact, the site has a copyright date of 2006. The panoramic photo was taken prior to any earthwork – not that they would want to showcase the way it looks at present

path of destruction

Comment
In his four years as president, Scott Wilshaw has left a path of destruction and misery throughout the Okanagan and Peachland. The Trepanier Manor development is just a pile of failed promises, corruption and a proof for Wilshaw’s reckless behavior. After misleading the public, investors and customers about this development, now he seems to try to save his disaster development in an act of desperation.

July 25th, 2009: St. Elias Mines hosted a PR BBQ at the Trepanier Manor Development in Peachland. Scott Wilshaw noted that the Trepanier Manor Development is a very exclusive project. What a joke. I invested a few years ago when they managed to build up some hype. Still invested. Would have been better off setting the money on fire. Other Investors have threatened to withdraw their money from Trepanier Manor. Now it came out that Wilshaw is not paying his bills and screwing over his partners! It certainly hasn’t been the “get ‘um before they are gone” project that it was touted to be. Trepanier Manor will soon go into receivership, most of the partners are gone and the development is falling apart. Great job Peachland electing this clown Businessman of the Year.

Trepanier Manor, has not done much in a long time, except strip 6 metres off the top of the bench and leave a very ugly landscape.
Development in itself is not the answers. Communities which focus only on development are not sustainable. They become very expensive and often polluted.
Long term sustainable planning for development and community growth is essential. In other words we need an OCP with vision and teeth!

My girlfriend said the work has now stopped and she heard they were bankrupt.. I didn`t want to mention bankrupt, but appears just about anything goes with these guys.

A friend told
Scott Wilshaw and Trepanier Manor has been kicked out from the Peachland Chamber of Commerce and the Peachland Economic Development Committee

Trepanier Manor – its disgusting

Tabletop Mountain was a nice mountain …NOW THE WHOLE TOP IS SKINNED… they call that development? Its disgusting, city council should all be fired for allowing such a disgrace … shame on you Scott Wilshaw …
Trepanier Manor will probably be pointed to for decades as an example of real estate development run amok. Most people in Peachland were unaware that Tabletop Mountain would be reduced to a pile of rubble until they saw the destruction.

Years ago I had a small dispute with Scott Wilshaw.
He appeared to me to be arrogant and gave little thought to as to how he interacted with people, unless it was in his interest.
He had total disregard for traffic laws, as he drove around in his black Range Rover with Trepanier Manor plastered all over the sides.
Disregard for little traffic laws is often the tip of the iceberg for disregard of all laws and regulations that got into the way of his greed.
I figured that it was only a matter of time before Trepanier Manor would be caught up in its own arrogance and lies.
It has finally happened.

Friends invested a few years ago when Wilshaw managed to build up some hype. Still invested. Would have been better off setting the money on fire.
Matcon Construction Ltd. is suing him for Millions! Several other pending lawsuits! Fraud cases! Long Delays! Construction was supposed to start in 2006 but there is not even a footing yet. It certainly hasn’t been the “get ‘um before they are gone” project that it was touted to be.
Anyone would be stupid to get involved with this “Disaster Manor” project.

A lot of leaches crawled around Scott Wilshaw and Trepanier Manor, but now they all all running and hiding in hopes no one reviews their internal deals.
Unfortunately they will take down allot of hard working people that believed their continuous BS.
The blame solely lies on Scott Wilshaw, he is a lying, cheating, stealing bastard.

Kelowna, August 2010
Workers, contractors waiting to be paid
Some construction staff working at the Trepanier Manor development in Peachland haven’t been paid since April.
“I’ve got outstanding invoices from April that they haven’t paid. There are subtrades waiting to get paid,” said Alan who runs a water landscape business. “I’m going to lose my house over this, and nobody’s stepping up to the plate and saying why they have no money”.
He’s heard explanations about the banking woes and that Trepanier Manor is getting sued, but the bottom line is: “There’s no money there, and us little guys are getting the shaft.”
“I’d have to sit and wait for a year while the court issue a settlement, and then … I’m not getting any money and my house is gone,” he said. He will be taking the developer Scott Wilshaw to small-claims court.
Trepanier Manor was a proposed hotel and 20 homes development located in Peachland.

I’m so sorry for all people who trusted this guy

What is going on at the Trepanier Manor development in Peachland?
Found the following comments at a Kelowna forum website – WOW
The Trepanier Manor Disaster.
What a joke at Trepanier Manor. Why don’t you interview Scott Wilshaw about not paying all his bills and screwing over his partners!! Great job Peachland electing this clown Businessman of the Year….what a joke
Scott Wilshaw at Trepanier Manor is too busy getting sued by everyone else to even have time to bother with me!!! Listen closely, I’ll type this slowly so you can comprehend…..Scott Wilshaw, a cook, and a blatant snake oil salesman doesn’t have 2 pennies to rub together. This entire farce called Trepanier Manor has failed…the bank is foreclosing…everyone loses!! The reason the negativety surrounds Wilshaw is because he brings it on….again, Scotty made his bed..time to sleep in it.
Theresa: “try and build a luxury hotel” – HaHaHa – Wilshaw is trying! He does not know the first thing about how to build a hotel. He is no professional, he is stupid. He was fired from all his former employers and he adorns himself with borrowed plumes.
Theresa: “has not broken any law” – HaHaHa – the Supreme Court convicted him of “false and misleading information” and he does not follow the rules and local bylaws. Where is the promised water reservoir, why are the cottages and the hotel bigger than specified in the development permit? Wilshaw is known for going ahead without approval.
Theresa: “people of Okanagan … crucify him” – Bravo people of the Okanagan – Scott Wilshaw is an arrogant, stupid, person with his British “low-class” accent. You poor bastard donkey arse bugger.
Theresa: “cant believe the negativity that surrounds him” – Scott Wilshaw has created the negativity himself. He has brainwashed people in the Okanagan but now they realize that he is an impostor and crook. Little advise, go back to your pots and pans.
Friends invested a few years ago when Wilshaw managed to build up some hype. Still invested. Would have been better off setting the money on fire.

Cardan Construction would be stupid to get involved with this “Disaster Manor” project.
Trepanier Manor is shortly before going into receivership. Business partners are gone and the development is falling apart. Where is the Relais & Châteaux membership Wilshaw promised – I guess they don’t take windbags.
The Trepanier Manor project is a disaster.
Wilshaw came up with this insane scheme – is the worst development ever – a disaster and long overdue.
Wilshaw couldn’t speak an honest word if his life depended on it. His double talk speaks for his profits only – all others are getting ripped off.
Wilshaw: “Residents are invited to the MacKinnon Road site for Trepanier Manor to see our entranceway, take a tour of the luxury show home”
Go – have a look – the entrance is crap and unfinished – the waterfall a joke and unfinished, the pond a stinking mosquito hole, the gate so cheap it doesn’t even fit, no style, the show home is a small crappy shack and all the other cottages will be so close together – the only privacy is behind a wall, no view, a lot of traffic, a lot of noise, overpriced ….
The plan was to create a hype – push the hotel – sell it, take the profit and leave Peachlanders with a pile of shards.
Wilshaw went from President to Director to Hotelier to Businessmen of the year, what a joke, to company official to landscaper to windbag.
He is not able to do it. No experience, no knowledge. He is just a smooth talking imposter. An everybody in Peachland and the Okanagan knows that.
Give up, Scott Wilshaw because most of us aren’t listening to your crap anymore.
I’m so sorry for all people who trusted this guy.
