October 2011Trepanier Manor project in Peachland faces receivership!!
Trepanier Manor
Scott Wilshaw
Byron Dafoe
Richard Dudelzak
Eagle Mountain Investments
Officially announced in February, 2006, Trepanier Manor was described as an ultra luxurious, 38-room hotel with 20 upscale homes on just over 25 acres of property off MacKinnon Road.
Winter 2009, Matcon Construction put in servicing for the property, including water and sewer lines, electrical cables and other underground services. Prior to servicing, a show home was constructed on the property.
Fast forward to present day and it seems there has been no action at the site.
But the action in the courts is heating up. Trepanier Manor has more lawsuits (now 7) against it than it has homes built.
- March 2, 2010, Matcon Construction (File Number 86533) filed a lawsuit against the developer. The construction company claimed the developer still owes $510,459, according to court documents.
- July 23, 2010, Royal Bank of Canada (File Number 44537) claims that over $420,000 is left owing by the group and rumor has it that the bank has taken possession of the Trepanier Manor show home!
- January 18, 2011, Business Development Bank of Canada (File Number 45175) started a suit against Trepanier Manor, DaFoe, Dudlezak, Wilshaw and others, claiming that a $150,000 loan was unpaid.
- July 15, 2011, Canadian Western Bank (File Number 91989) began proceedings against Trepanier Manor, claiming that the company defaulted on its mortgage. The Canadian Western Bank is going after Wilshaw, Dafoe and Dudelzak in the amount of $4.6 million, alleging that the three principals of the project signed a limited liability guarantee to secure the mortgage. Canadian Western also asks the court to appoint a receiver for the project and put the whole project into receivership which would instigate the selling off of Trepanier Manor assets to pay the mortgage.
- Trepanier Manor is also involved in several other lawsuits. July 2009, Ponderosa Golf Course developer Treegroup (File Number 31887) sued Trepanier Manor for false and misleading information. February 2011, Super Save Disposal (File Number 90307) and June 2010, Capri Insurance (File Number 87757) have each started a suit against Trepanier Manor / Scott Wilshaw as well.
